Article 1: Vehicle Condition - Usage. Repair

The client declares having thoroughly inspected the vehicle and acknowledges its good working condition and cleanliness. The client agrees to return the vehicle well washed on the outside and inside, otherwise they must pay the washing fees.

The client declares having verified that the five tires equipping the vehicle are in good condition, without cuts and that their wear is normal. In case of deterioration of one of them for a cause other than normal wear, the client agrees to immediately replace it with a tire of the same size and brand as the rented vehicle.

Normal mechanical problems are the responsibility of CASARIDE, however any repair resulting from either an abnormal problem or client negligence will be at the client's expense.

Clause under review

Damage that the client may cause to mechanical parts located under the rented vehicle (oil pan, cross members, steering rods and arms, exhaust pipes, etc.) will be borne by the client.

The client may not claim damages from CASARIDE whether it concerns a delay in vehicle delivery, cancellation or repairs due to an abnormal problem occurring during the rental.

CASARIDE's liability cannot be invoked even in case of bodily or property damage resulting from a defect, manufacturing fault or previous repairs.

The client is formally forbidden to leave MOROCCAN territory aboard the rented vehicle without written authorization from CASARIDE.

The rented vehicle may not be used for the following purposes:

  • Transport of goods, particularly those in violation of laws and regulations in force (Narcotics, Alcohol, etc.)
  • Transport of passengers for profit purposes
  • For towing or assisting any vehicle
  • Sports competitions, rallies, circuit reconnaissance...
  • Terrain not suitable for the nature and resistance of the rented vehicle, under penalty of bearing the costs of observed damage

In case of confiscation by Customs or Tobacco Authority, the client agrees to pay the amount due up to the date of confiscation, the amount of the vehicle price according to the current trade-in value, all legal fees incurred against them, and all late payment interest in case of non-payment of sums on time.

Article 2: Insurance - Accident

The client has noted that they were insured, according to the general conditions of insurance policies contracted by CASARIDE and declares having acknowledged them.

The vehicle is insured against theft, fire, civil liability, transported persons, defense and recourse, collision damage with a deductible of 10% on the new purchase value. The radio, telephone, accessories, all clothing or objects located inside the car, in the trunk, on the roof rack of the car for which the client remains their own insurer.

In case of an accident, the client must pay CASARIDE a deductible of 10% on the new purchase value. Also the rental until the car is repaired.

The client must declare to CASARIDE immediately any accident, theft or fire, even partial, of which they could be victim, under penalty of forfeiture.

The client must irrevocably provide CASARIDE with an amicable report stamped by assistance assessors or that of police or royal gendarmerie authorities, whether the accident is bodily or not.

The client must take photos at the accident scene.

The client must under no circumstances discuss accident liability nor treat nor negotiate with third parties. In no case may the number of persons transported in the rented car exceed that indicated on the insurance policy covering said vehicle, under penalty of only the client's liability being engaged.

The tenant's liability will not be released in case of an accident caused by their fault, and will bear all damage caused to the vehicle; and if they are not at fault, they will bear the immobilization (maximum 60 days) of the rental value.

Article 3: Rental. Prepayment - Extension

The rental amount is payable in advance.

The rental day begins from the time the vehicle is picked up. Any day started is due. If the client wishes to keep the vehicle for a period longer than that indicated on the contract, they must first obtain CASARIDE's express and written consent and must also pay CASARIDE the amount of the additional rental, failing which the client must return the rented vehicle and pay the amount of the additional rental.

If the client does not return said vehicle within 48 hours, they will be considered as having diverted it and will be liable to criminal prosecution for theft, breach of trust, and using the vehicle against CASARIDE's will in accordance with the provisions of articles 505 and 547 of the Moroccan Penal Code.

CASARIDE therefore reserves the right to recover its vehicle without any prior notice by calling upon a bailiff. To dispel any controversy, the only means of notifying our company is by email or registered letter with acknowledgment of receipt.

The return of the rented vehicle will be carried out at CASARIDE's office. In case of dispute, the tenant will bear all legal costs incurred by CASARIDE as well as registration costs and possibly fines, taxes and duties that CASARIDE would be forced to pay.

Article 4: Vehicle Documents & Keys

The client must return, at the end of the rental along with the vehicle, the registration card and all other documents necessary for circulation, failing which, the rental will continue to be billed to the client at the initial price until recovery of the documents, or establishment of their duplicates also billed to the client. In case of loss of the ignition key, the renter must sign a commitment to this effect and pay the costs of duplicating the new key.

The client agrees to let no one drive the vehicle except themselves or any person authorized by CASARIDE (in writing) and assumes full responsibility in case of lending the vehicle to a third party vis-à-vis CASARIDE as well as vis-à-vis local authorities and justice.

Article 5: Refund

The client agrees not to demand from CASARIDE any refund for an unused rental period.

Article 6: Vehicle Repair by the Client

The client agrees to:

  • Sign the vehicle return slip on which the return circumstances are indicated
  • Sign the receipt voucher in case of payment
  • Sign the contract when picking up the vehicle

In case of non-compliance by the client with one or the other of the clauses contained in this contract, CASARIDE reserves the right to withdraw the vehicle from them, without notice. In case of any dispute, CASARIDE has the choice to bring the matter either before the courts of CASABLANCA or before those of the client's residence.

Article 7: Traffic Violations

The tenant acknowledges their responsibility for all traffic violations automatically detected by radar.

Article 8: GPS

All our vehicles are equipped with a GPS tracker to identify the car in case of accident and to track their maintenance and locate them in case of theft.
